In the case of maintenance claims, two things are important: quick assertion and knowledge of all legal possibilities to reduce the maintenance. Especially in the case of high-earning spouses, there can be considerable potential for savings.
Custody and access rights
Disagreements about custody and access rights can arise not only after separation or divorce, but also in unmarried couples. For example, unmarried fathers are not automatically entitled to custody or access rights. The right of access is a sub-area of parental care. Each parent has the right to contact with his or her child. And the child also has the right to contact with each parent. The final assets are calculated for the day on which the court serves the divorce petition. An additional statement of assets at the time of separation prevents the spouse who is obliged to provide information from using the separation period to set aside assets.
