    Maintenance

    There are a vari­ety of main­te­nance claims. In the event of sep­a­ra­tion or divorce, the most impor­tant are sep­a­ra­tion and post-mar­i­tal main­te­nance as well as child main­te­nance. In addi­tion, main­te­nance claims on the occa­sion of a birth may come into con­sid­er­a­tion. Many high earn­ers are also con­front­ed with parental maintenance.

    In the case of main­te­nance claims, two things are impor­tant: quick asser­tion and knowl­edge of all legal pos­si­bil­i­ties to reduce the main­te­nance. Espe­cial­ly in the case of high-earn­ing spous­es, there can be con­sid­er­able poten­tial for savings.

    Custody and access rights

    Dis­agree­ments about cus­tody and access rights can arise not only after sep­a­ra­tion or divorce, but also in unmar­ried cou­ples. For exam­ple, unmar­ried fathers are not auto­mat­i­cal­ly enti­tled to cus­tody or access rights. Our lawyers will help you to assert cus­tody rights or oppose an appli­ca­tion for joint cus­tody where the best inter­ests of the child so require.

    The right of access is a sub-area of parental care. Each par­ent has the right to con­tact with his or her child. And the child also has the right to con­tact with each par­ent. If con­tact is denied or if con­tact is to be sus­pend­ed for rea­sons of the child’s best inter­ests, our lawyers will also assist you in judi­cial con­tact proceedings.

    The law pro­vides in § 1378 BGB that the spouse who has gained more must com­pen­sate the oth­er spouse for half of the surplus.

    When cal­cu­lat­ing the equal­i­sa­tion claim, the amount of the assets on three cut-off dates is deci­sive. The first cut-off date for deter­min­ing the ini­tial assets is the day of the mar­riage. The final assets are cal­cu­lat­ed for the day on which the court serves the divorce peti­tion. An addi­tion­al state­ment of assets at the time of sep­a­ra­tion pre­vents the spouse who is oblig­ed to pro­vide infor­ma­tion from using the sep­a­ra­tion peri­od to set aside assets.

At least 60 of the cas­es han­dled must have been court cas­es. Fur­ther­more, only those who have already been prac­tis­ing as a lawyer for at least three years may call them­selves a fam­i­ly law specialist.

    The Board of the Bar decides on the award of the title after the exam­i­na­tion com­mit­tee has giv­en its opinion.

    Annual continuing education obligation pursuant to § 15 FAO
