    Divorce procedure

    The fam­i­ly court, a divi­sion of the local dis­trict court, is respon­si­ble for divorces. The fam­i­ly court not only deals with the divorce itself, but also with the so-called divorce-relat­ed mat­ters.     Legal consequences of separation

    The spous­es live sep­a­rate­ly if there is no domes­tic com­mu­ni­ty between them and one spouse clear­ly does not want to estab­lish it because he or she rejects the mar­i­tal com­mu­ni­ty. Sep­a­ra­tion does not nec­es­sar­i­ly require one spouse to move out of the mar­i­tal home. Rather, it can also take place with­in the mar­i­tal home.

    The sep­a­ra­tion year begins with the sep­a­ra­tion, after which a peti­tion for divorce can be filed. From the time of sep­a­ra­tion, there is also a claim to sep­a­ra­tion main­te­nance under sec­tion 1361 of the Civ­il Code and a claim to infor­ma­tion about the spouse’s assets under sec­tion 1379, para­graph 2 of the Civ­il Code. From a tax point of view, joint tax assess­ment remains pos­si­ble even in the year of separation.

    Legal consequences of divorce

    Both the ser­vice of the peti­tion for divorce and the legal effect of the divorce decree trig­ger many legal con­se­quences. Divorce not only affects main­te­nance, mar­i­tal gain and pen­sion rights, but also health insur­ance, inher­i­tance rights and wid­ow’s pensions.

    As a rule, the right of spous­es to inher­it expires as soon as the divorce peti­tion is served.

    When the divorce becomes final, the spous­es are also legal­ly sep­a­rat­ed. There is no longer a claim to sep­a­ra­tion main­te­nance. How­ev­er, the claim for sep­a­ra­tion main­te­nance can be con­vert­ed into a claim for post-mar­i­tal main­te­nance. This does not arise auto­mat­i­cal­ly, but must be assert­ed by the enti­tled spouse.
