Legal consequences of separation
The spouses live separately if there is no domestic community between them and one spouse clearly does not want to establish it because he or she rejects the marital community. Separation does not necessarily require one spouse to move out of the marital home. Rather, it can also take place within the marital home.
The separation year begins with the separation, after which a petition for divorce can be filed. From the time of separation, there is also a claim to separation maintenance under section 1361 of the Civil Code and a claim to information about the spouse’s assets under section 1379, paragraph 2 of the Civil Code. From a tax point of view, joint tax assessment remains possible even in the year of separation.
Legal consequences of divorce
Both the service of the petition for divorce and the legal effect of the divorce decree trigger many legal consequences. Divorce not only affects maintenance, marital gain and pension rights, but also health insurance, inheritance rights and widow’s pensions.
As a rule, the right of spouses to inherit expires as soon as the divorce petition is served.
When the divorce becomes final, the spouses are also legally separated. There is no longer a claim to separation maintenance. However, the claim for separation maintenance can be converted into a claim for post-marital maintenance. This does not arise automatically, but must be asserted by the entitled spouse.
