    Maintenance

There are a variety of maintenance claims. In the event of separation or divorce, the most important are separation and post-marital maintenance as well as child maintenance. In addition, maintenance claims on the occasion of a birth may come into consideration. Many high earners are also confronted with parental maintenance.

In the case of maintenance claims, two things are important: quick assertion and knowledge of all legal possibilities to reduce the maintenance. Especially in the case of high-earning spouses, there can be considerable potential for savings.

    Custody and access rights

Disagreements about custody and access rights can arise not only after separation or divorce, but also in unmarried couples. For example, unmarried fathers are not automatically entitled to custody or access rights. Our lawyers will help you to assert custody rights or oppose an application for joint custody where the best interests of the child so require.

The right of access is a sub-area of parental care. Each parent has the right to contact with his or her child. And the child also has the right to contact with each parent. It makes sense to have a contact arrangement that provides clarity for all parties involved. If contact is denied or if contact is to be suspended for reasons of the child’s best interests, our lawyers will also assist you in judicial contact proceedings.

    Gain after divorce

The law provides in § 1378 BGB that the spouse who has gained more must compensate the other spouse for half of the surplus.

When calculating the equalisation claim, the amount of the assets on three cut-off dates is decisive. The first cut-off date for determining the initial assets is the day of the marriage. The final assets are calculated for the day on which the court serves the divorce petition. An additional statement of assets at the time of separation prevents the spouse who is obliged to provide information from using the separation period to set aside assets.

Our lawyers pursue a two-stage strategy to resolve the conflict. First, we rely on an out-of-court negotiated solution that takes into account the interests of both spouses. If the other spouse refuses to accept an out-of-court solution, we represent your interests vigorously in court.
